These terms and conditions form a legally binding agreement between you (the Artist) and ArtGallery, the supplier of the Service. Your statutory rights are unaffected.

You are: An artist using our services to market and sell artworks.


1. Definitions

  • Us/Our/We: Refers to ArtGallery.
  • You/Yours: Refers to you, the artist using our services.
  • Site/Sites: Refers to artgallery.co.uk or any other sites owned by us.
  • Artwork(s): Refers to the artwork(s) you own and offer for sale on our site.
  • Service: Refers to the process of displaying, marketing, and selling your artwork through our site.

2. Acceptance of Artist

2.1 We reserve the right to accept or decline your application to market your artwork through our site. By submitting your application, you accept these terms and conditions.
2.2 You warrant that all the information provided to us is accurate and up-to-date.
2.3 You agree to have your artwork and its descriptive details displayed on the site.
2.4 You will notify us of any changes in your information, including your contact details, artwork pricing, and sales status.


3. Acceptance of Artwork

3.1 We reserve the right to accept or decline your application to market any artwork on our site.
3.2 Upon a sale, you are entering into a legally binding agreement with us to complete the sale and dispatch the artwork within the agreed timeframe.


4. Non-exclusivity

4.1 You may sell your artwork through other channels simultaneously, as long as:

  • 4.1.1 It does not affect your ability to deliver the artwork to the customer within the specified time.
  • 4.1.2 You do not offer your artwork at a lower price through another channel than you offer it on our site.
    4.2 If the artwork is sold elsewhere, you must immediately remove it from sale on our site.

5. Copyright

5.1 You confirm that all artwork sold through our site is free from any copyright restrictions or intellectual property disputes and that you are the rightful owner of the artwork.
5.2 The copyright remains with you even after the ownership of the artwork is transferred to the customer.
5.3 You grant us a perpetual, irrevocable license to use images of your artwork on the website and in marketing materials, including online advertising, social media, and offline campaigns.


6. Illustrative Images

6.1 You must provide at least two high-quality images of each artwork:

  • Gallery Image: Showing the entire artwork, including frame (if framed). Minimum pixel width of 600px.
  • Detail Image: A close-up showing a portion of the artwork to illustrate its texture or grain. Minimum width of 600px.
    6.2 Images must be submitted in JPEG format.

7. Pricing and Artwork Details

7.1 You are responsible for setting the sale price of your artwork, which should include VAT (if applicable), delivery, insurance costs, and our commission. Our standard commission rates are:

  • 35% for online sales
  • 50% for sales in physical venues
    7.2 We may agree to offer discounts or use discount codes up to a maximum of 15%. All artists must agree to accept these discounts.
    7.3 Once accepted, you agree to sell the artwork at the agreed price.

8. Delivery, Packaging, and Insurance

8.1 You are responsible for all costs related to packaging, delivery, and insurance. These costs cannot be reclaimed from us and should be factored into your artwork pricing.
8.2 You must ensure that artworks are securely packaged, labeled, and adequately insured for safe delivery to the customer.
8.3 Do not include contact details in the packaging that would encourage direct transactions between you and the customer.
8.4 You must arrange for the artwork to be delivered within five working days of receiving an order.
8.5 If you are aware of any reason why an artwork will be delayed, notify us immediately, and we will contact the customer to arrange a new delivery schedule.


9. Returns and Damaged Goods

9.1 If an artwork arrives damaged, you are responsible for retrieving the artwork at your own cost.
9.2 Claims for retrieval of damaged artwork must be made through the insurance cover provided by your courier.
9.3 If you have not insured your artwork adequately, you will be liable for retrieval costs.
9.4 The customer may return the artwork within 14 days of receipt, which constitutes order cancellation. You are responsible for delivery costs in this case.


10. Payment for Artworks

10.1 If your artwork sells, we will issue a purchase invoice for the sale price. Payment will be made no earlier than 28 days after we confirm delivery to the customer.
10.2 Payments will be made via bank transfer.


11. Ownership of Customer Relationship

11.1 The customer relationship is solely owned by us. You agree not to contact the customer directly or develop a direct relationship with them without our express written permission.
11.2 In case of returns or damaged goods claims, we may release your details to the customer.


12. Disclaimer

12.1 You agree to defend, indemnify, and hold harmless ArtGallery and our affiliates from any claims arising from your use of our services, including any violation of these terms.
12.2 We provide the service “as-is” without any warranties, express or implied.
12.3 This agreement is governed by English law, and any disputes will be settled in the courts of England.


13. Amendments

We reserve the right to modify these terms and conditions with at least 28 days’ notice via our artist newsletter.
